Shipments & Delivery - Shipping dates are approximate and deliveries are subject to delays. TOPS shall not be liable for any damage or penalty for delays or defaults in manufacture, delivery or shipment, or for failure to give notice of delay and such delay shall not constitute grounds for cancellation. TOPS will not be responsible for loss or damage in transit unless otherwise expressly agreed.

Product Changes - TOPS reserves the right to: (a) make changes in design, specifications, processes of manufacture and construction of its products, without notice, provided such changes do not materially affect performance; and (b) effect changes described in (a) preceding, without incurring any obligation to install such changes in articles previously purchased.

Applicable Law - This Agreement, and all questions arising in connection herewith, shall be governed by and construed in accordance with the laws of the State of California and the United States of America.

Cancellations & Returns - No goods may be returned for credit, repair, or replacement without prior TOPS approval. All return shipments shall be at shipper's expense.

Warranty - Third Orbit Power Systems (TOPS) warrants that the ITEMS LISTED BELOW shall be free from defects in material and workmanship for the stated period of time commencing from date of shipment or as stated below.
